The following agreement is between Linda L. Raeber, hereafter known as "Seller" and

hereafter known as "Buyer".

1. Seller guarantees this puppy/dog to be healthy and free of disease upon receipt by Buyer.
2. Buyer agrees to have the dog examined by a licensed veterinarian within 3 days of receipt. If health problems are found, the dog may be returned to the Seller within 7 days for a full refund, or replacement. If, however, the Buyer elects to keep the dog after veterinary exam, the Seller is not liable for any existing or future medical conditions except as noted below.
3. The puppy/dog is guaranteed to be free of hereditary hip dysplasia upon permanent radiographical examination performed between 24-30 months of age. The Buyer agrees to have his or her dog’s hips x-rayed at this time for evaluation, which must be performed by the Orthopedic Foundation for Animals in Columbia, MO. The Seller agrees to reimburse the Buyer the evaluation fee charged by O.F.A., once a copy of the report has been received by the Seller. It is also highly recommended that thyroid screening and certification, also done through O.F.A., be performed at the same time as the hip certification; fees charged by O.F.A. for this procedure will also be covered by Seller.
4. If a serious hereditary defect (ie: hip dysplasia, osteochondritis, hypothyroidism, entropion, severely undershot or overshot bite) is discovered within the first thirty (30) months of age, but not at the initial veterinary exam, the Seller at his or her discretion, agrees to either:
  1. Refund one-half the purchase price.
  2. Replace the animal with one of at least equal quality.

The Buyer must first provide written proof of the defect in the dog, and that it has been neutered. It does not have to be returned to the Seller. If the dog covered in this contract has been bred, produced, or sired a litter prior to O.F.A. certification, or determination of a serious defect, then the guarantee portion of this contract is rendered null and void.

5. The dog is guaranteed to be of the quality represented. If Show quality, then it will have no disqualifying faults, or other major faults that would prevent it from achieving its championship or companion dog title in a reasonable amount of time. If Breeding quality, then it will have no serious faults that would prevent it from being a high quality breeding prospect. If Pet quality, it will have no serious faults or impairments that would prevent it from being a healthy companion.
6. The dog is guaranteed to have the proper livestock guarding temperament, and the instincts to perform in this task, given the appropriate training to direct those instincts. Buyers are strongly encouraged to seek guidance from the Seller or experienced livestock producers prior to introduction of the dog to stock.
7. Every effort has been made by the Seller/breeder to produce a litter both physically and mentally sound, and the Seller will stand behind this breeding to the extent stated above. However, the Buyer accepts full responsibility for the proper care once the dog leaves the Seller, as the Seller cannot be held responsible for death, injury, or deformity of the dog due to illness, accident, or deviation from adequate care normally given a giant-breed puppy.
8. The Buyer agrees to continue the vaccination series already started, and to arrange for annual check-ups and routine rabies vaccinations. Annual heartworm testing is strongly encouraged. The dog shall not be kept in an unthrifty condition.
9. The dog shall occupy a suitable fenced area adjacent to the Buyer’s home, and shall be neither continuously tied nor allowed to roam at large. (This may be waived for Livestock Guardian Dogs).
10. The Buyer agrees to have a dog sold as "Pet quality" neutered after one year of age.
11. If the Buyer is unable to keep his or her dog, he or she agrees to return the dog to the Seller. The animal may not be sold, given away, placed in an Animal Shelter, or euthanized without written permission of the Seller. The exception to euthanasia would be in the case of injury or suffering on the part of the animal.
